Michigan's New Legacy Release Program

Michigan’s legislators and governor have approved House Bill 4583, which requires creation of the Legacy Release Program (LRP). Due to a surplus in the Refined Petroleum Fund, owners and operators with legacy releases could now have access to funding. Here are some key points about the new LRP.

  • Releases discovered and reported prior to December 30, 2014, and not closed prior to December 30, 2014, are eligible.

  • Costs for corrective action performed on or after December 30, 2014, can be requested for reimbursement.

  • 50% of eligible, incurred costs not exceeding 50% of the published Schedule of Costs can be approved.

  • Total reimbursement will be limited to $50,000 for all releases from a UST system at a single location.

 
The Michigan UST Authority will administer the LRP, along with the UST Cleanup Fund which is for releases reported after December 30, 2014.

DEQ will need time to develop forms and guidance, and Pinnacle will be ready to assist you with preparing and submitting claims for either the new LRP or the UST Cleanup Fund.
