Will Prevailing Wage Rates Now Be Reimbursable in Illinois?

The Illinois Pollution Control Board (IPCB)  recently sided with a claimant to approve costs using rates that exceed maximum payment amounts (Subpart H) published by the Illinois Environmental Protection Agency (IEPA). 

In its decision, the IPCB found that the rates requested by the claimant may be eligible for reimbursement, even though the rates exceed the maximum amounts in Subpart H. However, rates which exceed the maximum rates are only eligible if those rates are, in fact, prevailing wage.

In this situation, the claimant provided justification in its Corrective Action Plan & Budget by documenting the prevailing wages of the project’s county and providing previously incurred actual cost comparisons, demonstrating that the proposed disposal and backfill budget would exceed IEPA rates (Subpart H) by 31.79%. 

With this decision, Pinnacle believes that a precedent has been set and that a shift will be seen in IEPA’s budget reviews.

2016 Fiscal Year Budget Status

It has been reported that Illinois legislative leaders have made minor progress aimed at ending the state budget stalemate.  A meeting was held on Tuesday, December 8th to try to end the deadlock and there are plans to meet again next week.

All payments from the Leaking Underground Storage Tank (LUST) Fund have been placed on hold until a 2016 Fiscal Year State Budget is approved and money is appropriated.
